This paper examines some of the possible legal implications of the production, marketing and use of expert systems. The relevance of a legally useful definition of expert systems, comprising systems designed for use both by laymen and professionals, is related to the distinctions inherent in the legal doctrine underlying provision of goods and provision of services. The liability of the sellers and users of, and contributors to, expert systems are examined in terms of professional malpractice as well as product liability. (...) The forefront of neurological care—and the neuroethical issues and methods focal to such practice—wasn’t what I initially intended to do professionally, but I think that therein is a good lesson for young people’s career aspirations. Simply put, one doesn’t always know where they’ll end up at the beginning of the journey, and as Kierkegaard said, life is lived forward, but is understood backwards (Kierkegaard 1843).In the nineties and the early 2000s, I was trying to help improve the quality of care of people at the end of life, and I wrote a book, entitled The Palliative Ethic of Care: Clinical Wisdom at Life’s End (Fins 2006), in which I addressed notions of phronesis—practical wisdom—in integrating theory and practice toward improving how people die. I became interested in the Quinlan case (Quinlan 1976), and the right to die, and around the same time, I ran into a colleague of mine at Cornell: Dr. Nicholas D. Schiff. Dr. Schiff is a neurologist, who was a protégé of Fred Plum, who was the originator of the concept of the vegetative state with Bryan Jennett, back in 1972. Fred was both of our teachers here at Cornell. Niko (Dr. Schiff) was interested in patients with disorders of consciousness, and was beginning to envision doing work—that ultimately, we did—using deep brain stimulation (DBS) to try to treat patients in the minimally conscious state, a category that was subsequently codified in 2002.I realized that a whole population of people—with these disorders of consciousness—had been somewhat marginalized, and their neglect essentially devolves back to the considerations of the right to die. The right to die was established in the Quinlan case because Judge Hughes—the presiding chief judge of the New Jersey Supreme Court—talked about Ms. Quinlan’s loss of a cognitive, sapient state as being the moral warrant for her right to die, given the fact that it was viewed as a futile situation. In late May 1984, Irish citizens were perturbed to hear that a thirty-one year old man died while participating, as a paid volunteer, in a clinical drug trial at the Institute of Clinical Pharmacology in Dublin. At the inquest, held in September 1984, the State Pathologist, Dr John Harbison, affirmed that the cause of death was the reaction of the trial drug Eproxindine 4/0091 with a major tranquillizer which had been given less than fifteen hours earlier as part of regular (...) treatment for a psychiatric disorder. Dr. Hittinger's book causes us to remember how genuinely delicate and refined is the balance between reason and faith in St. Thomas' view of human knowledge and its relationship to reality. This enabled St. Thomas to develop with discernment his notion of (...) the natural law, because St. Thomas understood that an act of genuine intellection distinguished in order to unite, not separate. Therefore, there was an intrinsic unity to truth and a unity to philosophical experience which reflected reality-something which has gotten lost in the contemporary morass of interminable dialectics. Have the contemporary attempts to retrieve a notion of the natural law succeeded in maintaining this balance? If such attempts have not succeeded in maintaining the requisite balance, what are the consequences of the loss of this balance for the success of their endeavor? When in the history of philosophical experience this balance cannot be maintained, one is forced to move in one of two directions. The first is towards a kind of fideism in which the fundamental questions raised by reason are only resolvable by the faith; thus philosophy is absorbed into theology. The second is towards the claim that reason can answer all that is answerable (which may be very limited) and thus faith becomes subordinate to reason. The latter either leads to rationalism or a variety of positivism. For Rittinger what appears to be a contemporary attempt to retrieve natural law moral philosophy has proven itself unable to avoid a fideistic solution to moral philosophy; for faith in the end resolves all the fundamental issues raised in regard to moral philosophy. The beginning of the discussion of moral philosophy and man as the author of his actions was very carefully placed in the writings of St. Thomas. It is only after St. Thomas had established certain fundamental truths and principles in natural theology and the philosophy of human nature that he begins to discuss moral philosophy. St. Thomas first established the existence of a personal God, who is both the efficient and final cause of all finite being. God's being is also discovered to be identical to truth, goodness, and beauty. God is recognized as that which all men seek even though only the beatific vision will present this to the intellect and will with an all-consuming necessity. "Beings" are ordered in two ways, as parts of totality, and as things to an end. The ordering of things to an end is the most important, since the final cause is the cause of all the other causes. Therefore an identification of the final cause makes all the other causes and the 344 BOOK REVIEWS order in things intelligible. Also it is only after a great deal is known about human goods, and human nature, and the ordination of human goods that St. Thomas is ready to begin a discussion of the first principle that states the good is to be pursued or the good is to be done. St. Thomas has also established, through reason, that man by nature desires and should desire in justice to give God his due. There· fore religion properly understood is natural to man. The above pro· vided St. Thomas with the knowledge prerequisite for the development of a natural law moral philosophy. If one perceives that we are at a juncture in the history of philosophy where one no longer can develop or defend the kind of knowledge that is a prerequisite to the successful development of a natural law ethics, then this must he faced with all its consequences. Is a natural law ethics still viable? ABSTRACTPerhaps no American state has seen more legal activity on assisting suicide than Michigan, but despite legislation, a study Commission, several legal cases and a state Supreme Court ruling, the state seems much further from a humane resolution of the question than when the activities of Dr. Jack Kevorkian began in June of 1990. This note summarizes major legal events over a twelve‐month period , which included jury acquittal of Dr. Kevorkian, the inconclusive report of the Michigan Commission on Death (...) and Dying, the failure of the state legislature to enact legislation to replace the expired absolute but temporary prohibition, and the decision of the Michigan Supreme Court in Mich v. Kevorkian declaring assisting suicide a common law felony and ruling that in certain circumstances a person assisting suicide can be prosecuted for murder. The Commission's model decriminalization proposal and the bills subsequently introduced in the legislature , as well as the decision of the Supreme Court, are discussed. Certain puzzling features of the latter, especially with regard to the kind of causation that can turn helping another commit suicide into murder, are noted. (shrink)

Critiques of prenatal diagnosis and selective abortion are probably the most salient and most sophisticated of disability studies scholars’ engagements with bioethics, but there are many other topics over which disability activists and scholars have encountered the field of bioethics in an adversarial way, including health care rationing, growth-attenuation interventions, assisted reproduction technology, and physician-assisted suicide. -/- The tension between (...) the analyses of the disabilities studies scholars and mainstream bioethics is not merely a conflict between two insular political groups, however; it is, rather, also an encounter between those who have experienced disability and those who have not. This paper explores that idea. I maintain that it is a mistake to think of this conflict as arising just from a difference in ideology or political commitments because it represents a much deeper difference—one rooted in variations in how human beings perceive and reason about moral problems. These are what I will refer to as variations of moral psychology. The lived experiences of disability produce variations in moral psychology that are at the heart of the moral conflict between the disability movement and mainstream bioethics. I will illustrate this point by exploring how the disability movement and mainstream bioethics come into conflict when perceiving and analyzing the moral problem of physician-assisted suicide via the lens of the principle of respect for autonomy. Again, this opposition thrives on the contrast between the notion of actions that are right or wrong by nature, and the lack of uniformity which we observe in actual judgments.1 · Yet as Simon later observes: There is a rumor that modern ethnology has demonstrated the absence of uniformity among peoples in matters of so-called natural law. That is rather naive. This lack of uniformity was well known long, long before what is called modern science came to exist. LONG fact, modern ethnologists would be rather more critical and skeptical about stories of strange customs than men of antiquity or of the Renaissance.2 Simon recognizes that the opposition to natural law theory that is predicated on the notion that natural law implies the absence of divergent moral convictions is "as old as the theory." 3 Such objection is a mere prefatory hurdle marking one's entry into contemplation of the densely interwoven fabric of natural law. The subject of natural law is, Simon insists, difficult because it is engaged in an overwhelming diversity of doctrinal contexts and of historical accidents. It is doubtful that this double diversity, doctrinal and historical, can so be mastered as to make possible a completely orderly exposition of the subject of natural law.4 As Dr. Russell Rittinger points out in his introduction to the volume, Simon is aware that there is not merely one " tradition" of natural law, but several.5 The contrast between convention and nature is susceptible of quite diverse formulations, and these are in large part dependent upon social and institutional factors. Nonetheless, in Simon's focus upon the doctrinal and historical problematic of natural law theory, he achieves the difficult feat of elucidating root speculative questions. Indeed, it is a major strength of Simon's treatment that he is wary of the ideological use of natural law theory. As he puts it: an ideology is a system of propositions which, though undistinguishable so far as. expression goes from statements about facts and essences, actually refer not so much to any real state of affairs as to the aspirations of a society at a certain time in its evolution. These are the three components which, taken together, distinguish ideology from philosophy. The notion of truth which an ideology embodies is utilitarian, sociological, and evolutionistic. It may seem obvious that causing disability in another person is morally problematic in a way that removing or preventing a disability is not. This suggests that there is a moral asymmetry between causing disability and causing non-disability. This chapter investigates whether there are any differences between these two types of actions that might explain the existence of a general moral asymmetry. After setting aside the possibility that having a disability is almost always bad or harmful for a person (a (...) view that we have critiqued at length elsewhere), seven putative differences are considered. Ultimately, it is concluded that none of these seven factors can ground a general moral asymmetry between causing disability and causing non-disability, though each factor can provide some moral reason to avoid causing disability in certain particular cases. Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. It is sometimes argued that medical professionals should protect a future child's rights by prohibiting disabled parents from using technology to deliberately have a disabled child because disability is taken as an inevitable, severe threat to a child's otherwise “open” future. I will first argue that the open future that allegedly protects a child's future autonomy is precluded by the very conditions needed to develop that future autonomy. Any child's future will be narrowed as they are socialized in a way (...) that gives them the capacity for autonomous choice. However, oppressive master narratives can diminish a future child's autonomy by distorting their narrative identity and constricting their agency. In fact, the open future argument does just this by advancing one of the most damaging master narratives about disability: that disability inevitably and severely restricts a person's autonomy and closes their future. POPKIN ONE OF HUME'S MOST FAMOUS CRITICS, the great scientist Joseph Priestley (1733-1804), is scarcely mentioned or studied in the Hume literature.' Perhaps because of the course philosophy followed after Hume, the Scottish Common Sense critics and the German ones connected with Kant are given almost all of the attention. In this paper 1 shall try to correct (...) this oversight, and examine the background of Priestley's critique of Hume, both in terms of Priestley's scientific and religious views and in terms of Hume's influence at the time. I shall then evaluate the merits of Priestley's critique and attempt to determine whether it deserves further study or should be returned to the obscurity it has been in for almost two centuries. 2 Joseph Priestley was a nonconforming minister whose progressively radical views caused him to lose various posts. Eventually he became a millenarian, convinced that crucial signs of the end of the world were at hand: the events of the French Revolution; the purported discovery of the Lost Tribes in Afghanistan by Sir William Jones; plans or hopes for the Jews to return to Palestine and join forces with the Christians. After years of religious wanderings Priestley ended up a millenarian Unitarian, much in the tradition of Sir Isaac Newton, whose religious writing he used extensively, and of Newton's successor, William Whiston? Priestley taught science in various schools and was immensely influenced by David Hartley's Observations on Man. He found in Hartley's theory of association of ideas a naturalistic way of explaining human mental life. And in Hartley's millenarian views he located the sort of theology he was seeking. As a result of numerous, highly publicized, ethical breaches, firms and their agents are under ongoing scrutiny. In an attempt to improve both their image and their ethical performance, some firms have adopted ethical codes of conduct. Past research investigating the effects of ethical codes of conduct on behavior and ethical attitudes has yielded mixed results. In this study, we again take up the question of the effect of ethical codes on ethical attitudes and find strong evidence to suggest that (...) business professionals employed at firms with ethical codes of conduct are significantly less accepting of ethically questionable behavior toward most stakeholders. Disability activists have sometimes claimed their disability has actually increased their well-being. Some even say they would reject a cure to keep these gains. Yet, these same activists often simultaneously propose improvements to the quality and accessibility of assistive technology. However, for any argument favoring assistive over curative technology to work, there must be a coherent distinction between the two. This line is already vague and will become even less clear with the emergence of novel technologies. This paper asks and (...) tries to answer the question: what is it about the paradigmatic examples of curative and assistive technologies that make them paradigmatic and how can these defining features help us clarify the hard cases? This analysis will begin with an argument that, while the common views of this distinction adequately explain the paradigmatic cases, they fail to accurately pick out the relevant features of those technologies that make them paradigmatic and to provide adequate guidance for parsing the hard cases. Instead, it will be claimed that these categories of curative or assistive technologies are defined by the role the technologies play in establishing a person’s relational narrative identity as a member of one of two social groups: disabled people or non-disabled people. After defining integrity capacity and framing it as part of a strategic resource model of sustainable global competitive advantage, the stakeholder costs of integrity capacity neglect are delineated. To address this neglect issue, the authors focus on the cultivation of judgment integrity to handle behavioral, moral and hypothesized economic complexities as key dimensions of integrity capacity. Patients who are imminently dying sometimes experience symptoms refractory to traditional palliative interventions, and in rare cases, continuous sedation is offered. Samuel H. LiPuma, in a recent article in this Journal, argues that continuous sedation until death is equivalent to physician-assisted suicide/euthanasia based on a higher brain neocortical definition of death. We contest his position that continuous sedation involves killing and offer four objections to the equivalency thesis. First, sedation practices are proportional in a way that physician-assisted suicide/euthanasia is not. (...) Second, continuous sedation may not entirely abolish consciousness. Third, LiPuma’s particular version of higher brain neocortical death relies on an implausibly weak construal of irreversibility—a position that is especially problematic in the case of continuous sedation. Finally, we explain why continuous sedation until death is not functionally equivalent to neocortical death and, hence, physician-assisted suicide/euthanasia.
